Comments on Findings <br /> I. Legal , Financial , and Compliance Information - Rule 2.03 <br /> The legal , financial , and compliance information for Eastside Coal companv is <br /> located on_pages 7 to 17 of the permit application, and was updated in January <br /> of 1990. <br /> Eastside Coal Company has received no violations of the Reaulations of the <br /> Colorado Mined Land Reclamation Board for Coal Mining during the 3 year period <br /> preceding the permit renewal application. <br /> The operation is in compliance with the requirements of this section. <br /> II. Land Use - Rules 2.04.3, 2.05.5 and 4.16 <br /> There have been no changes to this section. The post-mining land use proposed <br /> and approved by the Division for the permit area is undeveloped rangeland. <br /> The operation is in compliance with the requirements of this section. <br /> III. Cultural and Historic Resources - Rules 2.04.4 and 2.05.6(4) <br /> There are no changes to this section. The operation is in compliance with the <br /> requirements of this section. <br /> IV. Geology - Rules 2.04.5 and 2.04.6 <br /> There have been no changes to this section. The reader is referred to pages <br /> 23 through 32 of the original Findings Document. The operation is in <br /> compliance with the requirements of this section. <br /> V. Surface Water Hydrology - Rules 2.04.5, 2.04.7, 2.05.3(4), 2.05.6(3) , <br /> and 4.05 <br /> Sediment pond SP-1 drains the mine portal area, where offices are currently <br /> located. A clean-water diversion prevents flow of undisturbed area runoff <br /> onto the site. Mine discharge water is pumped from the mine into SP-1 . <br /> The planned office area north of the portal yard has not yet been <br /> constructed. A small -area exemption was granted by the Division to cover this <br /> area. The approved refuse.. d.i.sposa.l facility and its related ditches and- <br /> sediment pond, on the west side of Harvey Gap drainage, have also not been <br /> constructed. <br /> -5- <br />
