Your inspection report indicates a <br />potential "problem" related to the exposure of groundwater in a pit. excavation at the mine. We <br />are in agreement that a portion of water contained in our south pit is likely related to groundwater <br />inflow. We are confident that the flow is from the upper Dawson Formation, and we have <br />initiated efforts to obtain a well permit. <br />We have retained the services of Martin and Wood Water Consultants, Inc. (M&W) and Anne <br />Castle, of Holland and Hart, to assist us through the well permitting process. To date we have <br />determined that the subject mine is within the Upper Black Squirrel designated water basin, and <br />as such will be subject to the regulatory requirements of that water basin. We are currently <br />evaluating those requirements. Further, we have learned that the State Engineer's office maps do <br />not currently recognize that the Dawson aquifer exists at the subject property, so this issue must <br />certainly be addressed during the well permitting process. M&W have engaged a water broker <br />who is actively pursuing augmentation water. Once appropriate augmentation water is secured, <br />we can formulate a Substitute Water Supply Plan and ultimately a well permit application.
