Cattany <br />Division Director <br />Natural Resource Trustee <br />Marcia, pursuant to your request, I have reviewed the above referenced TR-48 initial adequacy <br />review response, dated April 30, 2008, submitted by Jim Stover of J.E. Stover & Associates, Inc. <br />Items 1 through 11 of our initial adequacy letter were from my March 14, 2008 review memo to <br />Joe Dudash. <br />Based on my review of the cover letter responses and associated page amendments, I believe the <br />submittal has adequately addressed all of the items with the exception of Item #6 and Item #11. 1 <br />have the following comments regarding these two items: <br />6. Narrative associated with this item in our original letter described the need for a <br />comprehensive listing of average topsoil replacement thickness for each logical <br />reclamation parcel. This was because the narrative regarding topsoil replacement was <br />scattered through various sections, different areas were apparently subject to differing <br />replacement depths, and there was a general lack of clarity. Our specific request for <br />revised information was probably not worded as clearly as it could have been. The <br />operator's response provided specific information related to areas which have not yet <br />been topsoiled, but will be topsoiled in the upcoming reclamation project. The need for a <br />comprehensive listing of soil replacement thicknesses applicable to the various reclaimed <br />areas throughout the mine site is still warranted. A table keyed to a map or maps would <br />probably be the most concise way to present this information. <br />Please provide a comprehensive listing of the applicable average topsoil replacement <br />thickness for each logical reclamation parcel that has been or is to be topsoiled. <br />11. The commitment set forth in Item 11 of the April 30, 2008 cover letter (to submit a <br />reclamation plan for cropland areas at the loadout by 12/30/08) is acceptable to the <br />Division. <br />Please incorporate this commitment into a logical section of the amended <br />reclamation plan narrative.
