MERRILL DR - <br />PUEBLO WEST, CO 81007 4EG 0 5 2007 <br />PHONE: 719-240-9424 FAX719-583-0768 _ <br />Mining snd Saiety <br />RE: Request extension to correct Items # 1 and #2, under "Problems/Possible Violations and <br />Corrective Actions" listed in the Inspection Report dated 0926/2007for MLRB permit No.4-7 <br />1983-175, Alamosa Pit # 2, Southwest Ready Mix, Inc. <br />Dear Ms. Pickford: <br />You conducted a mine site inspection of my client's operation, Southwest Ready Mix, Inc. <br />Alamosa Pit #2, Permit No. M-1983-175. The inspection was conducted September 26, 2007. <br />In that inspection, you identified several items needing corrective action. Item number one (1) of <br />the inspection report requires actions necessary to address items that may be of concern to the <br />Division of Water Resources, Office of the State Engineer. Specifically, the corrective action <br />requires the Operator, Southwest Ready Mix, Inc. to, "Either fill the pit to at least two feet above <br />the ground water surface or demonstrate that the operation is in compliance with the Office of <br />the State Engineer within sixty (60) days of receipt of this inspection report." <br />Of the two options offered, the Operator chooses, at this time, to explore securing water rights <br />sufficient to satisfy SEO possible concerns. This process will take some months to conclude. <br />Southwest Ready Mix, Inc. is therefore requesting an additional 9 months from the date of this <br />letter to perfect the necessary water rights. In addition, the Operator will provide up-dates as to <br />its progress in securing sufficient water rights at three month intervals- <br />Item number two (2) in the September 2e, 2007 inspection report concerned placement of an <br />"...impermeable berm below the firel storage tanks and either have the contents of the 55-glion <br />drums certified as non-hazardous or have the drums and their contents removed from the site and
