RULE 6.5 <br />Geotechnical Stability Exhibit <br />A geotechnical stability exhibit was not prepared for this amendment application because <br />conditions in the western expansion area do not differ significantly from those of the existing pit. <br />The pit has been mined with %2H:1 V highwalls for over 20 years with no documented incidents <br />of slope failure. In addition, a 1/2H:1 V slope is typically used for similar operations throughout <br />the State. Because the pit is located above the water table and does not need to be dewatered, <br />the threat of slope failure due to water pressure is also removed. <br />Connell Resources has proposed 25 foot setbacks from the adjacent property boundary and the <br />nearby access road which, based on their experience at the pit, they feel is adequate to protect <br />nearby structures. However, these proposed setbacks will result in mining occurring less than <br />200 feet from Todd & Catherine Camilletti's house and the southern property fence that is jointly <br />owned by the Camilletti's and Willard More. Pursuant to Rule 6.4.19 of the DRMS guidelines, <br />Connell Resources has included language in the First Amendment to the lease with Todd & <br />Catherine Camilletti (see paragraph 5 of the lease attached to Exhibit N) which states that fair <br />compensation will be provided by Connell if the Camillleti's house is damaged by mining and <br />reclamation activities at the Camilletti Pit. In addition, Connell has acquired the attached <br />notarized agreement with Willard More stating that fair compensation will be made if the <br />southern property fence is damaged by mining activities <br />Camilletti Pit <br />DBMS 112 Permit Amendment <br />Page 24
