NOTICE OF PROPOSED DECISION <br />The Colorado Division of Reclamation, Mining and Safety proposes to approve Technical Revision <br />Application No. 53 (TR-53) for the Bowie No. 2 Mine (Permit No. C-1996-083), submitted by Bowie <br />Resources, LLC. In Technical Revision No. 53, Bowie Resources LLC is proposing to drill one mine <br />dewatering well and construct 1000 feet of buried 6 inch diameter pipeline in the vicinity of the <br />intersection of Dove Gulch with Hubbard Creek for the Bowie No. 2 Mine. Only construction of the <br />dewatering well and pipeline are proposed to be approved in TR-53. If Division approval is obtained <br />through a separate technical revision (TR-54), the dewatering well would be used to pump mine water out <br />of the mine and, ultimately, into the North Fork of the Gunnison River, after demonstrating that the mine <br />water meets applicable water quality standards. Mining of the underlying B-seam coal can not proceed <br />until water accumulated in the D-seam workings above is removed. <br />The Bowie No. 2 Mine is an underground coal mine located in Delta County, approximately 5 miles <br />northeast of Paonia, Colorado. Coal interest is Federal and private, and the surface affected is Federal and <br />private land. The permit area encompasses approximately 5,304.80 acres. <br />This proposed decision is based on a finding that the proposed operation will comply with all <br />requirements of the Colorado Surface Coal Mining Reclamation Act, Section 34-33-101, et seq., C.R.S., <br />and the regulations promulgated thereunder. The protections for non-mineral resources brought forward <br />by the USDA-Forest Service GMUG as the land management agency are a part of the Division's <br />proposed decision and documentation for TR-53. <br />Copies of the proposed decision are on file for public inspection at the Colorado Division of Reclamation, <br />Mining and Safety, Room 215, Centennial Building, 1313 Sherman Street, Denver, Colorado 80203. <br />Persons with an interest that may be adversely affected by the proposed decision may request a formal <br />hearing before the Mined Land Reclamation Board on the proposed decision. Such request must be made <br />within ten (10) days of the initial publication of this notice, must be in writing, and must state with <br />reasonable specificity the reasons for the request and the objections to the proposed decision.
