Six monitoring wells remain at the mine site and two wells remain at the loadout. The proposed <br />decision for Bond Release application SL4, submitted to the Division on September 10, 2007, is <br />awaiting sealing of the six wells at the mine site. Sealing of monitoring wells 79-1, 79-2, 79-3, <br />79-61, SP-01, and AO-2A is planned to occur during the Fall 2008 by the operator. The two <br />wells at the loadout, AP-1 and AP-2, will be sealed at final bond release at the loadout. <br />KCC reclaimed ponds C and G in 2006. Sediment ponds A, B, D, E, and F have been approved <br />to remain as permanent structures in support of the post-mining land-use of rangeland and <br />wildlife habitat. <br />Since the permit renewal of January 11, 2002, there have been no Notices of Violation issued. <br />SECTION II - REVISIONS TO THE PERMIT <br />This section lists revisions to the permit since the last renewal, March 17, 2006. Since the last <br />permit renewal there has been no increase in bond amount required as a result of revisions to the <br />permit. <br />Minor Revision No. 43 was submitted on September 27, 2007. A decision to approve the <br />revision was made on September 28, 2007. This revision provided an update of Kerr Coal <br />Company's executive office address and described the proposed post-mining fencing plan. <br />Technical Revision No. 22 was submitted on February 16, 2006. TR22 was approved on <br />September 26, 2007. This revision approved the retention of Pond F as a permanent pond in <br />support of the post-mining land-use of rangeland and wildlife habitat. <br />Technical Revision No. 23 was submitted on June 15, 2007. The Division approved TR23 on <br />September 26, 2007. This revision approved termination of vegetation and water monitoring, <br />and approved permanent retention of two portions of the light use road in support of the post- <br />mining land-use. <br />KCC submitted a request for a Bond Release (SL4) on September 10, 2007. SL4 requested <br />Phase I and II bond release on the loadout, and on portions of the mine area that had not <br />previously been included in bond release applications. SL4 also requested Phase III bond release <br />on 381.7 acres at the mine site. Not included in the Phase III request area are 8.0 acres at the <br />mine area that were seeded in 1999. The loadout was not included in the Phase III request as <br />well. A bond release inspection was conducted at the mine site and loadout on October 23, 2007. <br />Six monitoring wells remain at the mine and two monitoring wells remain at the loadout. KCC <br />plans to seal these wells in accordance with Rule 4.07.3 prior to the Division's proposed decision <br />on SL4. <br />SECTION III - STATUS OF STIPULATIONS <br />Twenty-three stipulations have been attached to permitting decisions, since the submittal of the <br />original permit application. All stipulations have been complied with and/or terminated. <br />4
