(Page 2) <br />MINE ID # OR PROSPECTING ID #: m_9n04-nQ9 <br />INSPECTION DATE: 9/1-9.19008 INSPECTOR=S INITIALS: FC-S <br />OBSERVATIONS <br />This was an inspection requested by the operator related to their submittal of a request to remove <br />approximately 123 acres (Cell 1) from their current permit area. The inspection was conducted by Eric Scott <br />and Tony Waldron of CDRMS. DRMS representatives met with Rob Laird of Asphalt Specialties at the site at <br />approximately 0930. The site entrance is located off the north side of Hwy 52 immediately east of the county <br />line between Boulder and Weld counties. <br />The primary focus of this inspection was to observe the existing conditions of the Cell 1 area, to gather <br />additional information on, and discuss issues related to, the request submitted by the operator. After a brief site <br />orientation by Mr. Laird, DRMS rode with him to inspect the Cell 1 area that Asphalt Specialties has requested to <br />have removed from the currently permitted area. The Cell 1 area has been mined out and no mining activities <br />are currently taking place there. The current approved reclamation plan for the Cell 1 states that it will be <br />reclaimed as a clay-lined 56 acre developed water resource pond with vegetated shorelines. DRMS collected <br />several photos of the area to document current site conditions. <br />The operator has entered into an arrangement with the City of Erie, and other parties, to convert the Cell 1 <br />area to a site for a municipal water treatment plant with an adjacent water reservoir, rather than the <br />developed water resource pond in the currently approved reclamation plan. The mine site is also signed at the <br />entrance with a public notice that it will be the future location of a municipal water treatment plant. <br />Current activity in the Cell 1 area consists of cleaning the floor of the excavation, providing drainage of the cell, <br />and some backfilling activity in the southeast part of the Cell in preparation for the reconfiguration of the area <br />for the City of Erie. <br />During the site tour, DRMS stated that although we understand the operator now has existing agreements with <br />the City of Erie, we could not release the site or the associated bonding because it was clearly not reclaimed in <br />any fashion, and furthermore, current site activities in the Cell 1 area were not in compliance with the approved <br />reclamation plan. The site representative requested that DRMS provide them with written guidance as to what <br />would be the best way to resolve the situation so that the Cell 1 area could be removed from the permit as <br />quickly as possible. Therefore, DRMS is requiring the operator to submit an amendment to the approved permit <br />to change the post-mining land use from a developed water resource to a "pre-construction" state for the <br />intended use by the City of Eire, and to revise the final configuration of Cell 1.
