M. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection of the McClane Canyon Mine conducted by Mike Boulay of the Division <br /> of Reclamation, Mining and Safety(DRMS) on September 11, 2008. Chuck Silengo of McClane <br /> Canyon Mine was present during the entire inspection. Weather conditions were cloudy and cool. <br /> Ground conditions were muddy in most locations of the mine. <br /> Roads <br /> With exception of one road segment as described below,roads were generally maintained and in good <br /> condition throughout the site. Road ditches were in good condition. Some erosion and rills are <br /> forming on the haul road surface at a location below the portals area. This section of the road will <br /> require blading and maintenance. <br /> Hydrologic Balance <br /> It rained the night prior to the inspection. The rain gauge located near the shop area was checked and <br /> showed .4 inches of precipitation. Drainage structures and diversion culverts in the portal area were <br /> clear of debris and appeared to be functional. Mine water was not being discharged from the mine <br /> during the inspection. The sediment pond has just recently been cleaned out. A large amount of coaly <br /> material and sediment has been removed and transported to the temporary coal waste pile area. The <br /> pond now has significantly more sediment storage capacity. The pond was retaining only a small <br /> amount of water. <br /> As noted in the previous inspection, some equipment had been placed in the upper end of the shop area <br /> collection ditch. The items have been removed as requested. The operator is planning to do some <br /> additional maintenance on the ditch segment including cleaning out weeds and regrading the ditch. <br /> Processing Waste <br /> The temporary coal waste pile area located above the sediment pond was inspected. The berm and the <br /> clean water diversion ditch around the waste pile and sediment storage area are well maintained and <br /> stable. Waste is being properly contained. Approval of the proposed permanent waste disposal site is <br /> still under review and pending approval of TR-16. <br /> Support Facilities <br /> As mentioned in the previous inspection several items of equipment were being improperly stored in a <br /> flat area north of the haul road, west of Culvert K. The items have been removed. <br />
