M. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a complete inspection of the Roadside Portals Mine conducted on September 12, 2008 by <br /> Mike Boulay of the Division of Reclamation, Mining and Safety Grand Junction Field Office. Tonya <br /> Hammond of Snowcap Coal Company(SCC) was present during the inspection. Weather conditions <br /> were sunny and warm. Ground conditions were wet in most locations due to precipitation from the day <br /> prior to this inspection. <br /> Availability of Records <br /> The availability of records was checked on September 12. All required records were on file and <br /> available for review at J.E. Stover&Associates offices. No problems were noted with the records <br /> review. See the attached Availability of Records checklist. <br /> Roads <br /> Roads were mostly dry in the locations west of the interstate and in the vicinity of the refuse disposal <br /> areas,North Portal, and UTL. Roads were damp and muddy in some locations at the South Portal area <br /> and North Decline. The 2-West Portal locations could not be inspected due to muddy and poor road <br /> conditions. <br /> Road ditches were in good condition and road culverts were all generally well maintained throughout <br /> the various mine site locations and support facility areas. <br /> Hydrologic Balance <br /> All site Sedimentation Ponds including UTL-1 & 2, 6, 7,8,9,10,11, and 13 were viewed. Sediment <br /> Pond No.2 at the UTL and Pond 8 were the only sediment ponds retaining water. UTL#2 only had a <br /> very small amount of water in the southwest corner. Pond 8 also had only a small amount of water, <br /> well below the level of the spillway. All other ponds were either dry or only just damp due to the <br /> recent rainfall. The CBA#1 Sump was dry. The sedimentation ponds are well maintained and capable <br /> of functioning as intended. All pond embankments, inlets and discharge structures were stable and no <br /> problems were noted at any of the sediment pond locations. <br /> Drainage and diversion ditches were stable with no significant erosion or other problems noted. Only <br /> the North Collection Ditch at the South Portals area had a small amount of water flowing in it which <br /> originates from the South Portals French Drain. <br />
