In accordance with procedures outlined in 30 CFR <br />906.30, Appendix B, the Forest Service reviewed the Technical Revision for post-mining <br />land use consistency with land use plan (GMUG Forest Plan), and the adequacy of <br />measures to protect non-mineral surface resources, as proposed by Bowie in their <br />application. <br />According to Bowie's Mine Permit and associated Map 13, the post-mining land use is <br />"Rangeland & Wildlife Habitat". This is consistent with the Forest Plan; however the Plan <br />specifically prescribes managing this area for wildlife habitat with an emphasis on Forest <br />Service Management Indicator Species (MIS). As such, there are specific requirements for <br />human activities in these areas, which are brought forward in Attachment A discussed <br />below. <br />Regarding the adequacy of measures to protect Federal resources not covered by the coal <br />lease, by evaluating current Forest Service direction and various resource specialist input, <br />the activities proposed in TR-53 must be conducted consistent with measures listed in <br />Attachment A in order to adequately protect surface resources on NFS lands. <br />In addition, provided that the application is not further modified, and the conditions of <br />Attachment A are carried forward in the DRMS' decision, this letter constitutes USFS <br />consent/concurrence to the decision. <br />Also, the FS requests that the future project related documents (e.g. decision and public <br />notices) ARMS acknowledge that protections for non-mineral resources brought forward by <br />the GMUG as the land management agency are included in the DRMS decision / <br />documentation. <br />Sincerely. <br />LEVI K.
