III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> over the years of irrigation, and perhaps variations in topsoil. A farm access road parallels 5th <br /> Road, within the permit boundary (Figure 8). If the landowner desires to keep this road as a <br /> permanent feature, WFC should submit a technical revision addressing Rules 2.05.5(1)(b) and <br /> 4.03.2(1)(g) and include a letter from the owner documenting that fact. Otherwise, the <br /> disturbance will need to be reclaimed consistent with the post-mining land use well in advance <br /> of a final bond release request so that the revegetation is well established. <br /> Goforth Parcel (IP, DP) <br /> The second cutting had been completed, and the hay was windrowed in preparation for baling <br /> (Figure 9). <br /> WFC Parcel (N of Burbridae) OP) <br /> This irrigated pasture had also produced its second cutting of hay for the season (Figure 10). <br /> Richards Parcel (DP). <br /> This parcel has been reclaimed Dryland Pasture. The vegetation is very sparse (Figure 11). <br /> Benson-East (IP) <br /> This field, planted more recently than the others, has a higher percentage of alfalfa. The second <br /> cutting had not yet occurred. <br /> Closing Comments <br /> This completed the field inspection for SL-11. In the office, the Division will evaluate the post <br /> mine contour map, the topsoil replacement depth map, the revegetation data and the <br /> sedimentation data. One item the Division has noted is that WFC used a proposed reference <br /> area standard rather than the approved technical standard for revegetation comparison in the <br /> bond release application. The application will need to be revised to demonstrate success using <br /> a comparison of the vegetative cover data from the reclaimed parcels for Irrigated pasture is <br /> compared the approved standard of 71.8%. The reclaimed parcels must be at least 90% of the <br /> standard (64.6%) to demonstrate success. <br /> New Horizon Mine C-1981-008 25-Aug-2008 <br /> -3- <br />
