G. Everist, Inc., respectfully <br />requests a partial release of the performance warranty and financial warranty associated with <br />the Golden phase of this mine. <br />We have completed a slurry wall liner around the Golden phase of the Fort Lupton Sand and <br />Gravel Mine. We received approval of the lining from the Office of the State Engineer on <br />January 29, 2007. The approval letter is attached. We are continuing to mine and concurrently <br />reclaim within the slurry wall, so this is just a partial release request. <br />As required in the Construction Materials Rules, Rule 4.16.1(2), following is the name, address, <br />and phone number of the owner of record of the affected land. <br />Owner Information <br />L. We would greatly appreciate if the Division calculates the two <br />financial warranty changes together (this partial release and the TR additional bond) and then <br />requires us to make only one financial warranty adjustment for the site.
