Twentymile Coal <br />Discharge (D0518897).DOC <br />Janet - <br />Attached are the components of a Minor Revision Application (MR08-230). This MR addresses the mine dewatering <br />modifications necessary to deal with the recent, unanticipated rise in water levels within our underground mine water <br />storage areas, and the resulting need for increased mine dewatering pumping and discharge. The modifications described <br />are intended to address both immediate and long-term mine dewatering and discharge needs, and to accommodate <br />potential water treatment options. A hard copy follows via US Mail for your files. <br />This MR specifically addresses one of the conditions in the recent emergency discharge agreement, reached through a <br />cooperative effort between TCC and the CDRMS. <br />For your reference, I have also attached to the MR transmittal letter, a memorandum from Jackson & Kelly, LLC <br />documenting a phone conversation last week with the CDPHE-WQCD confirming that water supply stream standards for <br />Lower Trout Creek are not applicable, because the WQCD does not show any registered water supply users on Lower <br />Trout Creek. This determination is consistent with the effluent limitations on the temporary certification (Coal General <br />Permit) for our emergency discharge to Foidel Creek from the 10RT Borehole(s), and with 5CCR 1002-31.11(6). <br />After you have opportunity to review the accompanying information, please feel free to contact me with any questions or <br />to dicuss related matters.
