Stipulation No. 20 <br />PERMIT RENEWAL NO. 2 (RN-02) IS A RENEWAL OF THE PERMIT AS A <br />RECLAMATION ONLY PERMIT. IN THE EVENT THAT THE LORENCITO CANYON <br />OPERATION IS PLANNED TO REOPEN FOR COAL MINING AND REMOVAL, THE <br />OPERATOR SHALL SUBMIT A PERMIT REVISION, RECEIVE APPROVAL FOR, AND <br />SUBMIT ANY INCREASE IN RECLAMATION BOND, PRIOR TO ANY ADDITIONAL <br />DISTURBANCE OF LANDS WITHIN THE PERMIT AREA. <br />Stipulation No. 20 remains active as a result of Permit Renewal No. 2 (RN-02). <br />Stipulation No. 21 <br />LORENCITO COAL COMPANY SHALL NOT IMPLEMENT ACTIVITIES APPROVED <br />UNDER TECHNICAL REVISION NO. 8 UNTIL THE REQUIRED BOND IS SUBMITTED <br />AND ACCEPTED BY THE DIVISION. THE REQUIRED LIABILITY FOR THE ENTIRE <br />MINE AS A RESULT OF TECHNICAL REVISION NO. 8 IS $2,853,681.00. <br />Since the permit is being renewed as a reclamation only permit and any future mining <br />operations would require a permit revision and new mine plan, a new reclamation cost <br />estimate would also be required based on a new, approved mine plan. Therefore, <br />Stipulation No. 21 is no longer necessary and is terminated as a result of Permit Renewal <br />No. 2 (RN-02). <br />Two technical revision applications, two permit transfers, one minor revision, and one bond <br />release have been reviewed and approved since the last midterm permit review in May <br />2005.
