(5) All aspects of the mining operation and Reclamation Plan that are subject to the <br />amendment will be subject to these Rules, as amended, in effect at the time the Permit is <br />amended. <br />As soon as we receive confirmation from you that we may consider TR02 as submitted as <br />consisting of ONLY the proposed changes to the reclamation configurations of Cells 2, 3, <br />4 and 6, and the associated changes in mining and reclamation plan as submitted, we will <br />process it as soon as practically possible. However, we cannot review your request for <br />the acreage removal and surety reduction as part of that revision. <br />Another option you have is to simplify the process by withdrawing the current <br />"combined" TR02 altogether, and resubmitting a new TR for only the proposed changes <br />to the reclamation configurations of Cells 2, 3, 4 and 6, and the associated changes in <br />mining and reclamation plan. The division would apply the previously submitted TR fee <br />of $216 to this new TR02, so you would not be charged twice for the revision. You will, <br />however, still need to submit a separate permit amendment application for approval to <br />cover the proposed changes for Cell 1. As soon as the permit amendment for Cell 1 is <br />approved and implemented, you may submit the request for the acreage release and <br />associated warranty reduction with all the supporting information you now have. <br />Please let us know how you would like to proceed.
