The soil loss comparison, to be inserted into Appendix C, <br />demonstrates that untreated drainage from the reclaimed area will contribute fewer <br />suspended solids to stream flow or runoff outside the permit area as untreated drainage <br />from the natural surrounding pre-mining area. Therefore, sediment ponds are no longer <br />required so they can be removed. <br />As requested by Oxbow in their August.29, 2008 letter to the Division, pond 5 will be <br />backfilled and graded by pushing in only the southern portion of the pond embankment <br />sufficient to route drainage from the coal mine waste disposal pile toe ditch into <br />Hubbard Creek. Reclamation of pond 5 will also include the removal discharge pipes <br />and filling in the emergency spillway. Reclamation of pond 4 will involve removal of the <br />discharge pipes and pushing in the northeast portion the pond embankment so <br />drainage is routed into Hubbard Creek. <br />Amended page 105, 108i, the four page soil loss comparison and Oxbow's August 29, <br />2008 letter are enclosed. <br />Sincerely, <br />J.
