According to,Jim, Western Fuels has submitted a verbal request for a waives
on the standard timing restrictions (November 1) and would like to drill the well in late September
without initiating the full burrowing owl survey protocols.
At this time it is our opinion that the potential for any adverse impact of the drilling activity to
burrowing owls is low during this timefiame. 1 he odds of this particular prairie dog burrow or series of
burrows hosting an active owl nest are small Assuming there is or was a nest at this location; it is
probable that by late September any young that might be present will have fledged and thus be capable
of avoiding the disturbance posed by the well drilling activities.
Based on these circumstances, the DOW will therefore waive the standard timing restrictions and
approves your request to drill the well in late September.
If you have any further questions please feel free to contact me.
S1nCer'e
Renzo elPiccolo
Area Wildlife Manager - Montrose
Colorado Division of Wildlife
DEPARTMENT OF NATURAL RESOURCES, Harris D Sherman, Executive Director
WILDLIFE COMMISSION, Robert Bray, Chair.
