Box 191 - 100 North 3rd Street Victor, Colorado 80860 (7191689-2977 - Fax (7191689-3254 Mr. Berhan Keffelew Environmental Protection Specialist Division of Reclamation, Safety and Mining, DNR 1313 Sherman Street, Room 215 Denver, CO 80203 Dear Mr. Keffelew: Cripple Creek & Victor Gold Mining Company (CC&V) is in receipt of your letter dated September 2, 2008, (received September 9, 2008) wherein CC&V is requested to waive the 150- day decision timeframe for the CC&V Cresson Project Mine Life Extension (MLE) application (Amendment No. 9) as established in your April 28, 2008 letter. We understand that the 150-day timeframe is premised on the application being deemed complex thereby providing additional time, in this instance an additional 30 days, to the standard 120-day decision timeframe. We understand and agree with your reasoning that a delay from the October 15-16, 2008 Board meeting will provide for a more orderly and thorough review of the CC&V responses (expected to be submitted on or about September 12, 2008) to the Adequacy Review Comments received from DRMS on August 25, 2008. In the interest of a thorough vetting of the technical issues associated with this application, CC&V is willing to extend the decision timeframes an additional 30 days in order to have a DRMS decision timely issued to accommodate the November Board meeting (tentatively scheduled for November 12-13). As we have described to DRMS, the MLE project schedule is critical and construction of the Phase 5 VLF extension needs to start during the 2009 construction season. This will require contacts to be let before the end of this year. Accordingly, CC&V requests a 30-day extension thereby facilitating the scheduling of the Amendment No. 9 MLE permit application before the Board at its November 2008 meeting. We believe that this will allow sufficient time for a thorough review and dialog of any remaining technical issues follg iking submittal of our response document.
