We understand that the 150-day <br />timeframe is premised on the application being deemed complex thereby providing additional <br />time, in this instance an additional 30 days, to the standard 120-day decision timeframe. We <br />understand and agree with your reasoning that a delay from the October 15-16, 2008 Board <br />meeting will provide for a more orderly and thorough review of the CC&V responses (expected <br />to be submitted on or about September 12, 2008) to the Adequacy Review Comments received <br />from DRMS on August 25, 2008. <br />In the interest of a thorough vetting of the technical issues associated with this application, <br />CC&V is willing to extend the decision timeframes an additional 30 days in order to have a <br />DRMS decision timely issued to accommodate the November Board meeting (tentatively <br />scheduled for November 12-13). As we have described to DRMS, the MLE project schedule is <br />critical and construction of the Phase 5 VLF extension needs to start during the 2009 <br />construction season. This will require contacts to be let before the end of this year. Accordingly, <br />CC&V requests a 30-day extension thereby facilitating the scheduling of the Amendment No. 9 <br />MLE permit application before the Board at its November 2008 meeting.
