Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Reclamation, Mining and Safety (Division) received a comment letter from the <br />CDOW regarding the Red Cliff Mine new permit application. We received the letter on September 2, <br />2008 after we already sent out our preliminary adequacy review letter on August 29, 2008. Therefore, <br />we are forwarding the attached letter from CDOW for your review and response. <br />The CDOW has comments including but not limited to the Baseline Wildlife Report, Mitigation of the <br />Impacts of Mining with regard to section 2.05.6(2) Fish and Wildlife Plan, and significant water <br />related issues including the potential for impacts to East Salt Creek, Mack Wash, and wetland and <br />riparian areas. <br />Please address all of the concerns presented by CDOW in the attached letter and provide substantive <br />responses including amended permit application materials as needed to adequately and fully address <br />each item of concern raised by CDOW. Your responses to the CDOW letter should be prepared and <br />submitted to the Division along with your responses to our preliminary adequacy review letter (dated <br />August 29, 2008) for the proposed Red Cliff Mine project. <br />If you have any questions, please contact me. <br />Sincerely, <br />/? b91^17 <br />Michael P.
