Cattany <br />Palisade, CO 81526 Division Director <br />Natural Resource Trustee <br />Re: Roadside Portals (Permit No. C-1981-041) <br />Technical Revision No. 57 (TR-57) Adequacy Review <br />Dear Ms. Hammond: <br />The Division of Reclamation Mining, and Safety (Division) has reviewed the above referenced <br />technical revision application materials submitted for the proposed change to the postmining land use <br />at the Overland Conveyor location. The Division has the following adequacy review comments. <br />1. Prior to approval of TR-57 we will require written comments from State and local government <br />agencies which would have to initiate, implement, approve, or authorize the proposed use of <br />the land following reclamation [Rule 2.05.5(2) b)]. Please contact the Mesa County <br />Department of Planning and Economic Development to obtain their comments on the proposed <br />plan regarding the postmining land use change at the Overland Conveyor as requested with TR- <br />57. Please forward Mesa County Department of Planning's comments to the Division for our <br />review. <br />2. On August 28, 2008 we received a comment letter from the Colorado Division of Wildlife <br />(DOW) regarding TR-57. Based on the location and type of action being proposed the DOW <br />believes impacts to the wildlife resource to be negligible. The DOW had no specific comments <br />that require a response from Snowcap Coal Company.
