M. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection of the Seneca II Mine conducted on August 22, 2008 by Mike <br /> Boulay of the DRMS. Dennis Bugay representing Seneca Coal Company(SCC) was present <br /> during the entire inspection. Weather conditions were sunny and cool. Ground conditions were <br /> dry throughout the mine site. Cattle were grazing in most areas of the mine. <br /> Hydrologic Balance <br /> Postmine drainage channels (with exception of PM-6) were dry and appeared stable throughout <br /> the site. PM-6 was flowing at the E1 road crossing due to the Spoils Springs located east of <br /> Road E1. Stock Ponds at several locations were retaining water and cattle were drinking from <br /> Stock Pond T32 in the upper Wolf Creek area as shown in Photograph#1. Postmine drainage <br /> control was functioning well and no problems were identified. <br /> The Truck Wash water supply pond has been removed but the location needs to be properly <br /> reclaimed. SCC has breeched the dam, and removed the pumps from the pond for use elsewhere. <br /> The water that normally gravity feeds to the supply pond from the Wadge Impoundment is <br /> diverted to the perimeter ditch around the shop facilities area and now flows to Pond 003. Please <br /> reclaim the location of the former water supply pond by regrading the site to the approximate <br /> original contour,redistribute an appropriate layer of topsoil and seed the area. As seen in <br /> attached Photograph#2 the location of the former supply pond needs to be properly managed and <br /> reclaimed. To ensure compliance,please reclaim this location as soon as practicable but no later <br /> than this fall. The Truck Wash settling pond remains at the site. It is no long in use since there is <br /> no water supply to the wash facility with removal of the supply pond. A small amount of water <br /> remains in the bottom of the settling pond. <br /> Roads <br /> Roads were dry and generally in good condition throughout the mine site. Road ditches were dry <br /> and stable. Culverts in the facilities area and along Road E1 were maintained and no problems <br /> noted. <br /> Support Facilities <br /> Weeds and overgrowth had recently been cut and trimmed away from the perimeter areas of the <br /> shop/warehouse. The facilities area and former office location were well maintained. <br />
