M. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection of the Yoast Mine conducted on August 21 and 22, 2008 by Mike <br /> Boulay of the DRMS. Dennis Jones of Seneca Coal Company(SCC) accompanied the DRMS <br /> on August 21 and Dennis Bugay representing SCC was present during the inspection on August <br /> 22. Weather conditions were sunny and warm on both days. Ground conditions at the mine site <br /> were dry. <br /> Roads <br /> The only activity at the mine site was at former Haul Road A where SCC is in the process of <br /> narrowing the road. A dozer was working to reconfigure the side slopes and road embankments. <br /> The sides of the road will be re-topsoiled and seeded. <br /> Hydrologic Balance <br /> Sediment Ponds 012, 013, 014, and new Pond 012A were viewed. Pond 012A as shown in the <br /> attached photo has just been built. This pond is retaining only a very small amount of water. <br /> Pond 012 was discharging clear water at the time of the inspection. There was no outflow from <br /> Ponds 013 and 014. Pond embankments and discharge structures were stable and functioning <br /> properly at these locations. The inlet to Pond 012 below the outfall of 012A is eroded from the <br /> recent heavy runoff this past spring. As shown in the attached photo a significant gully has <br /> formed in the channel between Ponds 012A and 012. Rill and gully repair is ongoing at the <br /> Yoast Mine and SCC plans to stabilize and repair the channel between the new Pond 012A and <br /> Pond 012. <br /> Slides and Damage <br /> A slump occurred along the side of Haul Road A at the upper end. SCC has done a good job at <br /> repairing the slump by regrading, topsoiling and reseeding the damaged area. The repaired slump <br /> is shown in the attached photograph. A temporary road has been constructed across the slide <br /> damaged area above Pond 012 for drilling access for a slide remediation plan and for access to <br /> construct Pond 012A. SCC is currently preparing a slide remediation abatement plan for the <br /> slide area above Pond 012. <br />
