Otherwise please update the permit page in Tab 3, Attachment 3-5. <br />Response: MR-28 was submitted on June 26, 2008 to address the name change and to update the adjudication file. <br />26. We have questions regarding documentation of landowner request for retention of proposed permanent facilities. Specifically, there are <br />very specific requests provided in Attachment 20-1 for retention ofpermanent structures on portions of the disturbed/reclaimed area <br />owned by Seneca Coal Company, Jahn Patrick, and Dennis Hallenback. There is also a February 1995 consent statement from <br />Charles B. Carroll, which would appear to provide the required road retention request for the Carroll family properly. No retention <br />requests were provided from 20 Mile Sheep Company, or Wilton Earle & Sons, who would appear to own panels affected by retention <br />• of the access road connecting RCR 27 with the mined area. <br />In addition, there is reference to Yampa Valley Electric Association's (YVEA) desire to retain the powerline extending from the <br />Rockcastle road up through the permit area to the substation, but written documentation from YVEA was not provided Also, the <br />disturbance corridor associated with the powerline appears to pass through property owned by Public Service Company of Colorado <br />(PSCO), but there was no letter of request from PSCO for retention of the powerline. <br />Please clarify whether Charles A Carroll is the spokesman for the Carroll Family property, address the <br />apparent discrepancies regarding retention requests from 20 Mile Sbeep Company, Wilton Earle & Sons, <br />YYEA, and PSCO, and amend the application accordingly. <br />Response: <br />Carroll Family Pro Per Tty - When the agreement was originally signed Charles B. Carroll was the designated <br />representative ... this signed agreement is still valid and goes with the property, no matter who is the current family <br />representative. However, the contact name and address provided in the permit should be used for contact purposes. <br />20 Mile Sheep Company LLC - This property has undergone a name change recently, but is still owned and controlled <br />by John Maneods (formerly Maneotis Sheep Company). <br />Wilton Earle & Sons - The Wilton Earle & Sons owned and controlled property is adjacent to, not within, the Yoast <br />permit boundary, therefore no permission is required. <br />YVEA - SCC has previously received verbal declaration from YVEA that YVEA indeed owns and controls the line <br />and that the line should remain inplace; however it is very difficult to obtain written documentation/decisions from <br />utilities and bureaucracies in a timely manner. SCC has been in recent contact with YVEA and is awaiting signed <br />• confirmation and request letter. This letter will be forwarded when received.
