CaftanY <br />Division Director <br />Natural Resource Trustee <br />Re: Acceptance of Notice of Intent to Construct, Whirlwind Mine, Permit No. M-2007-044. <br />Dear Mr. Osborne, <br />The Division of Reclamation, Mining and Safety has received Energy Fuels Notice of <br />"Intent to Construct" for the construction of stormwater management structures as <br />approved in the Reclamation Permit Mine Plans. DRMS staff visited the site on August <br />21St, 2008 as part of the pre-construction review. An inspection report is forthcoming. <br />The construction schedule was discussed and meets the requirements of Rule 6.4.19(15). <br />Per our review, Energy Fuels will keep staff advised of construction progress and notify <br />them when pertinent construction is complete but not yet covered. Lewicki and <br />Associates will be monitoring construction progress and provide a post construction <br />engineering report to the Division. <br />Please consider this letter as the notice to proceed with construction provided the required <br />reclamation bond has been accepted and posted with the Division's Denver Office.
