Recently, OMLLC <br />participated in the August 27, 2008 bond release inspection of the minesite. The <br />purpose of this letter is to provide our follow-up comments after the inspection. This <br />letter is also a supplement of.our previous June 29, 2005 letter to Mr. Jim Stover <br />regarding the minesite. (copy attached). <br />Hubbard Creek Culvert <br />OMLLC continues to require that the 9'. Hubbard Creek culvert crossing be left in place. <br />Gravel Road from the Entrance Gate to Pond 5 <br />OMLLC plans to use the gravel road extending from the entrance gate located near the <br />9' Hubbard Creek culvert to Pond 5 for property access as a future ranch road after final <br />bond release by MINREC. Therefore, OMLLC continues to require that the gravel road <br />be left in place as a ranch road and not otherwise reclaimed. <br />Blue Ribbon Pond 4 (Outfall 004) and Pond 5 (Outfall 001) <br />Oxbow mining continues to have no particular plans for these ponds and suggests that <br />the ponds be reclaimed in accordance with the approved Blue Ribbon mining and <br />reclamation plan. We presume the south embankment of Pond 5 will be removed and <br />graded into the pond area sufficient to route drainage from the refuse pile toe ditch, <br />south past the footprint of the re graded embankment to Hubbard Creek. This plan will <br />also serve to remove the pond outlet works. <br />Similarly, because the Pond 4 embankment is so well vegetated with mature willows <br />and cedars we suggest that the east embankment be removed and graded. into the <br />0 Page 1
