A. copy of the final. Drainage. Plan and, Report was provided to Mr. ,Gary DeWitt in <br />response to concerns raised at the MLRB Pre-Hearing Conference on August 20, 2008. 'The <br />report states "capacity of the channel was 'estimated by calculating the full flow capacity of a 36" <br />RCP culvert at a 2% slope. One half, foot of freeboard for the channel was used as a factor of <br />safety because ofthe lack of design information- for,the existing -36" RCP." A'copy of the <br />Drainage Plan and Report: is included as an attachment to this letter. <br />Another issue that was discussed with Mr. Gary DeWitt was in regard to the end-use of the fines <br />from the settling ponds. In the letter to CDOT dated July 3, 2008, Connell Resources, Inc. stated <br />"[T]he operator will adhere to the -specifications set forth in the State Engineer's.Office guideline <br />for backfill and the clay liner. Fines from the settling ponds will not be mixed with the <br />overburden and will not be used -as backfill." Furthermore, Mr. John Warren: of Connell <br />Resources, Inc. restated .that the fines would not be mixed with the backfill or clay liner material <br />during the MLRB Pre-Hearing Conference on August 20, 2008. Connell Resources, Inc. does <br />not intend to operate in violation of the State Engineer's Office guidelines and/or procedures. A <br />copy of the letter to CDOT Dated July 3, 2008 is included as an attachment to this letter. <br />Finally, Mr. Gary DeWitt had some concerns regarding sheet flow drainage patterns from. <br />Highway 392 in the area of.the SerFer Pit.. The existing grade on the site naturally slopes toward <br />the Cache la Poudre River. The Mining Plan and Reclamation Plan do not allow for increases in <br />elevation on the site. As a result, sheet flow, from Highway 392 will not be impeded or <br />redirected back towards-Highway 3,92 as a result of mining and reclamation activities on the - <br />proposed site.
