Please update the emergency response plan information. <br />Published Notice: Please ensure that the notice includes the correct date for the closing of the public comment <br />period, by inserting the date that is ten days after the publication date. Also, please ensure that the legal <br />description is correct, so that the notice will not have to be republished. After publication, please obtain a <br />notarized affidavit of publishing and send it to this office. <br />Additional Materials: All subsequent submittals should be mailed to me at the Durango field office (address <br />below), including the adequacy responses, signed delivery receipts for the certified mailing of the notices, <br />receipt(s) for filing of all additional materials with the county clerk and recorder, and the publisher's affidavit. <br />Please provide two copies of all submitted materials, especially any oversized materials or those in color. <br />Responses to the above items is necessary to comply with the adequacy requirements for this amendment, as <br />well as to provide sufficient information to calculate a bond amount reflective of the reclamation work to be <br />done. These items must be received before the decision date, in order to consider an approval, though the bond <br />revision may occur after that date. <br />Decision Date: The Board Order set the decision date as 30 days after submittal of the amendment application. <br />The date on which the Division found the application "complete" is the submittal date, which was August 22, <br />2008. This is how the September 22, 2008 date (also shown on the enclosed letter) was figured. Normally, if <br />the application is not adequate for approval, we would extend the decision date. In this case, however, I cannot <br />extend it nor approve your request for extension; that would be a matter. to be brought before the Board for their <br />consideration. Given this, I suggest that we try to get all issues addressed by the present decision date. If at all <br />possible, please try to provide all items to me a couple days before the decision date to allow sufficient time for <br />review. <br />Please note that there are a few issues still needing to be addressed at the site, including the disposition of the <br />underground sump, for example.
