Permit No. COG-850000 <br />Facility No. COG-850048 <br />Page la <br />Colorado Discharge Permit System Regulations <br />CERTIFICATION <br />under <br />GENERAL PERMIT FOR COAL MINING FACILITIES (SIC NO: 1222) <br />Category 07, Sub-category 5, General Permits, Current fee $7801year (CRS 25-8-502) <br />This certification specifically authorizes Twentymile Coal Company to discharge from the Foidel Creek Mine <br />as described below and in accordance with the General Permit for Coal Mining Facilities (Surface Runoff). <br />All correspondence relative to this facility should reference the specific facility number, COG-850048. <br />Permittee <br />Twentymile Coal Company <br />29515 County Road 27 <br />Oak Creek, CO 80467 <br />Facility Contact <br />Brian Watterson, Environmental Specialist <br />970-870-2750 <br />Project Name, Activity and Location <br />This is an active coal mine that has individual permits (CO-0042161, CO-0027154) for coal mining activities. This permit is covering <br />an additional outfall that has become necessary on an emergency basis. There has been an unanticipated and rapid increase in the level <br />of mine water in the sealed mine workings, which has resulted in a decision to temporarily suspend mining operations, and withdraw <br />all personnel. Mining operations will remain suspended until mine water elevations can be reduced to safe levels by pumping and <br />discharging water from the sealed mine storage areas. <br />This permit will address the emergency need for temporary discharge of stored mine water from the sealed underground workings. <br />Discharge will last for approximately 4 months to reestablish safe operating conditions. Stormwater discharges from this facility are <br />already covered under the individual permits and/or under a stormwater permit. If this outfall is to become a permanent feature, the <br />permittee is required to amend the individual permit to include the outfall in that permit. <br />The mine is located in portions of T4N, T5N, R85W, R86W and R87W in Routt County. <br />Outfalls <br />Outfall 001 A is the designated outfall for this permit. This outfall is to Foidel Creek with an expected flow range of 1.2 to 1.4 mgd. <br />Treatment will be applied via a modular mobile treatment unit, as necessary to meet the permit limitations. The outfall will be located <br />at 40° 22' 8.4" N latitude, 107° 2' 21.9" W longitude, to Foidel Creek. <br />Effluent Parameters <br />The discharge is to Foidel Creek, within Segment 13b of the Yampa River Sub-basin, Upper Colorado River and North Platte River Basin, <br />found in the Classifications and Numeric Standards for the Upper Colorado and North Platte River Basins (Regulation No. 33; last update <br />effective 3/1/08). Segment 13b is Undesignated, and is classified for the following beneficial uses: Aquatic Life, Class 1 Cold; Recreation <br />Class la; and Agriculture. <br />Other Conditions <br />Antidegradation <br />Antidegradation review does not apply to this permit as this is a temporary discharge, and therefore exempt from an antidegradation <br />review. If this is to become a more permanent discharge point, the permittee will be required to amend the individual permit to include <br />this outfall. For this reason, this certification will expire in one year. <br />Groundwater Contamination <br />If groundwater contamination is encountered, then the permittee is to contact the Division, cease all discharges, and if appropriate, <br />contact the owner of the collection system receiving the discharge. Since the discharge of contaminated groundwater is not <br />covered under this permit, the permittee shall immediately apply for a groundwater remediation certification, which will include <br />appropriate requirements for additional discharge monitoring and on-site environmental response capabilities. <br />Sampling <br />Sampling shall occur at a point after treatment, or after the implementation of any Best Management Practices (BMPs). If BMPs or <br />treatment are not implemented, sampling shall occur where the discharge leaves control of the permittee, and prior to entering the <br />receiving stream or prior to discharge to land. Samples must be representative of what is entering the receiving stream. <br />ISSUED and EFFECTIVE AUGUST 28, 2008 EXPIRES: SEPTEMBER 1, 2009
