III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during <br /> the inspection. Comments also describe any enforcement actions taken during the inspection and the <br /> facts or evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Janet Binns of Colorado Division of Reclamation, Mining <br /> and Safety. Mr. John Weinman of Hydro-Environmental Solutions, Inc. accompanied the inspection as <br /> the permittee's representative. The site is an inactive load-out. The operation is approved to operate as a <br /> load-in facility too, but construction of off loading structures has not commenced. <br /> Records: Records for the Load Out were checked in the Hydro-Environmental office. Records are <br /> complete and well maintained. The Air Emissions permit had recently expired (8/23/2008). Since no <br /> loading or unloading activity is occurring on the site, the operator will wait until the operation is planned <br /> to reactivate prior to obtaining a new emission permit. This is acceptable with DRMS. <br /> HGTI has also recently received a renewed CPDS permit from CDPH&E. The operator will provide <br /> DRMS with this update. <br /> Hydrologic Balance: Pond I (Truck loop pond) was holding water but was not discharging. The June <br /> 2008 quarterly pond inspection has noted seepage at the discharge culvert. The inside of the culvert was <br /> damp but no sign of seeping was discerned. The area had received summer storms over the previous two <br /> weeks. <br /> Pond 2 (Rail loop pond) was dry. The pond bottom was well vegetated. <br /> Culverts and ditches throughout the mine site appear to be in good condition. Ditches were clear, <br /> Culverts at the facilities area were functional, and no maintenance items were identified. <br /> SAEs appeared to be in good condition. No concerns were identified at SAE locations. <br /> Support facilities: The loadout facilities are inactive. Appear stable and are clean of debris. The <br /> inactive hopper area at the truck loop has been covered with plywood to minimize unauthorized access. <br /> The operator is using the coal storage area as a staging area for storing drilling support equipment for <br /> exploration activities off the HGLO property. The operator has also fenced off access to the stacker& <br /> crusher to minimize unauthorized access. HGTI is fencing off a small pen to hold 3 young livestock <br /> calves adjacent to the office warehouse. This will not be a grazing operation due to the small size and <br /> relatively short duration to hold the animals. <br /> Wildlife One mule deer was observed along Dry Creek north east of the Train Loop Pond. <br /> Revegetation: The vegetation through out the site is adequate to control erosion. Temporary <br /> stabilization vegetation on the coal storage pad is effective in minimizing wind or water erosion. Weeds <br /> were few and only in small scattered spots.
