<br />III. COMMENTS - COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado DBMS. Bill Bear represented the <br />operator during the inspection. The longwall is currently operating in the B-7 panel. <br />Hubbard Creek Vent Shaft <br />The drilling of the vent shaft was going to be finished later during the day of the inspection. The steel shaft liner <br />has been installed and grouted. Once the drilling equipment leaves the site, the mud pit will be reclaimed. Then, <br />the vent shaft facilities will be built, protected by a fence. <br />The upland diversion ditch had sufficient capacity. The riprap in the steep section of the ditch was in place. Silt <br />fence was in place at the base of the vent shaft bench and between the road and the creek. The fence encircling <br />the mud pit was in place as well. The small seep from the mud pit was being collected in a small sump and was <br />being pumped back into the mud pit. <br />Surface disturbance markers were up around the disturbed area. Stream buffer zone signs were up but the mine <br />ID signs need to be put up on their posts. The road leading to the site was in good condition, with road ditches, <br />silt fence and straw bales in place. Straw bales and silt fence were up at the laydown area as well, which was <br />now mostly clear of any drilling equipment. There were no fuel leaks at the fuel facility. <br />Main Mine Site <br />The rock catchment berm above the utility bench was in place. No large boulders have fallen behind the berm to <br />date. The berm on the outside edge of the utility bench was in place as well. The ditch to the rear of the bench <br />had sufficient capacity. The road leading up to the bench was in good condition. The small slide above the road <br />and below the utility bench appears to have stabilized. There was a small volume of coal that was stockpiled on <br />the D-seam portal bench. There were no leaks at the fuel facility and surface disturbance markers were up. <br />The operator has a revision in to repair the slope between the B-seam portal bench and the haul road above the <br />bench. The excess material stockpile across the haul road from the portal bench was stable. However, Bowie <br />needs to reestablish the water bars on the road that goes up the stockpile. The main topsoil stockpile was well <br />-;vegetated. Topsoil signs were up. Ponds C and F have been recently cleaned. Pond B will be cleaned soon. <br />Unit Train Loadout <br />A loaded unit train was on site at the loadout and spur. There was a very small amount of coal fines at the base <br />of the loading bin but no problems with fugitive dust were observed. The loadout bench outslopes were well <br />vegetated. Pond J and pond K were dry. The mine ID sign was up at the entrance. <br />Pond J had been recently reconfigured for sediment control at the new coal waste pile, which is under <br />construction and which lies to the west of the loading bin. Topsoil was being salvaged at the coal waste site and <br />placed in the unit train loadout main topsoil stockpile. A collection ditch on the down gradient side of the newly <br />disturbed area that brings runoff to pond J was in place. Surface disturbance markers were up. <br />c:/word/bowie2/insp08O8
