III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DRMS.No one represented the operator <br /> during the inspection. <br /> Roads <br /> The paved haul road from the main entrance down to the facilities bench was in good condition. The guard rail <br /> was in place.The graveled east entrance road was in good condition as well.The dirt light use road along the <br /> railroad tracks was passable. <br /> Signs and Markers <br /> The mine ID signs were up at the required locations and contained the required information. <br /> Hydrology <br /> The eastside sediment pond had a little standing water in it,although well below the level of the primary <br /> discharge pipe. The gated valve on the pipe was in the closed position. The pond embankment was well <br /> vegetated.Pond inslopes and outslopes were stable. The emergency spillway had sufficient capacity. The <br /> westside dugout pond was dry. The single spillway had sufficient capacity. Pond inslopes were stable. <br /> The silt fence and straw bales were in place along the railroad track small area exemption. <br /> Topsoil Stockpiles <br /> The east topsoil stockpile had a good vegetative cover and showed no signs of erosional problems. The <br /> collection and diversion ditches were well vegetated and had sufficient capacity. The topsoil signs were up on <br /> the stockpile. The west topsoil stockpile also had a good vegetative cover,although it has turned brown. The <br /> berm that encircles the topsoil stockpile and acts to collect disturbed area runoff and divert undisturbed area <br /> runoff was in place. Topsoil signs were up on this stockpile as well. <br /> Facilities <br /> The crusher/screener and railcar loading facilities were in operation during the inspection. Only a moderate <br /> volume of coal was stockpiled on the facilities bench.No problems with fugitive dust were noted. The facilities <br /> berm was in place. There were no leaks at the fuel facility.No problems were observed at the substation,mine <br /> office, material storage area and the haul truck unloading and railcar loading structures. <br /> c:/word/terror/insp0808 <br />
