The Division cannot approve the PAP until the pending land lease or right-of-way is <br />secured from the Bureau of Land Management (BLM). Please refer to pages 2.03-7 and <br />8 of the PAP for a description of the Pending Land Lease or Right-of-Way from the BLM <br />located in Township 8 South, Range 102 West, 6th P.M. When the right-of-way is <br />obtained please update the PAP accordingly. <br />Rule 2.04.4 Cultural and Historic Resource Information <br />4. Please refer to the enclosed comment letter from the Colorado Historic Society (CHS). <br />Please address the Colorado Historic Society's concerns in a written response and with <br />amended application materials as deemed appropriate. The CHS has questions regarding <br />the project's area of potential effect and whether or not the inventoried areas shown <br />within the Class III Cultural Resource Inventory reports cover the permit area. On July <br />3'd we notified the CHS of the application and sent for their review the following: <br />Section 2.04.4 of the PAP, Volume VI Cultural Resources, and Map 14 Mine Plan. <br />There was some confusion regarding the permit area, because Map 14 does not show the <br />entire permit boundary. Upon receipt of the letter from the CHS, we have since <br />forwarded to CHS another map from the PAP (Map 01 Surface Ownership, which does <br />show the entire permit area). This should clarify the question regarding the permit <br />boundary. <br />Rules 2.04.4 (1) and (2) require that the application contain a description of the cultural <br />and historic resources listed or eligible for listing on the National Register of Historic <br />Places and significant known archaeological sites existing on the date of application <br />within all areas proposed or likely to be affected by surface activities or planned or <br />probable subsidence over the life of the mine. Further, the Division may require the <br />applicant, for good cause shown, to identify and evaluate important historic and <br />archeological resources that may be eligible for listing on the National Register of <br />Historic Places through collection of additional information, conducting of field <br />investigations, or other appropriate analyses.
