Startup of the plant was achieved in February 2008, which sets the 180-day <br />NSPS/MACT compliance deadlines in August 2008. According to your letter, however, multiple unforeseen malfunctions <br />and delays have precluded the facility from performing the initial compliance testing required by NSPS Subparts F, Y, 000 <br />and MACT Subpart LLL (as applicable) within 180 days from plant startup. <br />The Division has reviewed your letter and, pursuant to 40 CFR Part 60.8(d), hereby grants GCC Rio Grande, Inc. until <br />October 23, 2008 to submit the required NSPS initial compliance testing. Pursuant to 40 CFR Part 63.7(b)(2), the Division <br />grants GCC Rio Grande, Inc. until December 9, 2008 to submit the required MACT initial compliance testing. <br />Notwithstanding the above, GCC Rio Grande, Inc. remains responsible for operating in compliance with all terms of <br />Construction Permit 98PB0893.
