Pursuant to provisions contained in C.R.S.Sections 34-32-112.5 (2) and 34-32-103 (3.5)(a), we are requesting an exemption from DMO status for the Pitch Reclamation Project. As you know the reclamation and closure of this site is in an advanced state, and active mining operations have not occurred at the closed mine site since 1984. We believe it is inappropriate to apply DMO status to this reclamation/closure site based upon present conditions at the project and our intent to complete reclamation and closure pursuant to our project DRMS reclamation permit.
