by an application of one pore volume of hydrogen peroxide treated water. The rinsing is <br />followed by a period of water sampling until it meets less than 0.2, mg/l wad Cyanide. CC&V <br />states based on CC&V'S experience and reviewing other facilities, it is believed detoxification <br />can be properly achieved using two pore volumes of water and that the one pore volume of <br />hydrogen peroxide treated water will be unnecessary. Until such time CC&V, provides actual <br />data from similarly designed leach pads with Ore body and leaching procedures and <br />concentrators, DRMS, will continue to insist on the current approved detoxification plan and <br />will bond accordingly. The Division appreciates CC&V'S willingness not to question the triple <br />rinse cost at this time. <br />All other Exhibits were found to be adequate. As stated earlier, DRMS may have additional comments once <br />we get the chance to complete our review of the attached "Third Party Review" conducted by Dr. Dirk <br />Vanzyl, even though the report was provided to CC&V as agreed upon in the approval letter for the Third <br />Party Review. Also attached you will find comments received by the State Historical Society dated August <br />15, 2008 for your review and comments. <br />In order to meet the MLRB meeting dates of October 15-16, 2008 all issues have to be resolved to the <br />satisfaction of the Division no later than September 12, 2008. This is so the DRMS can send Notices to all <br />Parties with copies of our rationale to deny or approve the amendment application, and set the Pre-Hearing <br />date and time and the actual Board Hearing date in Cripple Creek.
