<br />Explanation of Request <br />Albert Frei and Sons, Inc. (AFS) proposes to mine and then <br />backfill with inert material on 7 parcels totaling 13.68+ <br />acres that are owned by CAP Land Company (CAP). CAP is <br />corporation that is owned by members of the Priola family. <br />The property was used historically for greenhouses, homes, <br />and general farming uses. It is zoned A-1 and I-1 with a <br />designated address of 7901 Dahlia Street, but is actually <br />located 1-,4+ to the southwest of Dahlia Street on the north <br />side of the I-76 Frontage Road. <br />The applicant is proposing to mine this property for sand <br />and gravel resources, and then backfill the property with <br />inert fill for future industrial development. As a first <br />step in this effort, the applicant has obtained a <br />Reclamation Permit from the State of Colorado's Division of <br />Reclamation, Mining, and Safety (DRMS) of the Department of <br />Natural Resources (File No. M-2007-087). Copies of various <br />Exhibits and other items from this Application are included <br />as part of this Explanation. In addition, a complete copy <br />of the DRMS Application along with all relevant <br />correspondence that was generated during the DRMS approval <br />process has been submitted separately from this Explanation <br />and may be referenced for more detailed information on any <br />aspect of the proposed mining and reclamation. <br />The Comprehensive Plan designates the area as a "Mixed <br />Use /Employment". North and west of the property is a City <br />of Thornton water storage reservoir. East and northeast are <br />industrially zoned and used properties with scattered with <br />newer and older industrial uses and occasional older <br />single-family homes. South, southwest, and southeast are <br />the I-76 Frontage Road and the main lanes of I-76. Across <br />I-76 is a swampy low-lying area caused by seepage from the <br />O'Brian Canal, and on the other side of the O'Brian Canal <br />are industrially zoned and utilized properties at much <br />higher elevation. The area is thus a mixture of older <br />formerly irrigated farm areas, older residential, excavated <br />gravel pit areas, and new and older industrial uses. <br />A copy of the DRMS Exhibit B Map is copied on the next page <br />to identify the property's location in relation to major <br />roads and features in the area. Following this map is an <br />Aerial Photo Map was also included in the DRMS application, <br />although it should be noted that many of the structures <br />shown on this Aerial Map have been removed.
