Division.of the Department of Public Health and <br />Environment (the Division) received - on June 04, 2008,, a: copy of a .document entitled "Revised <br />Operations Plan for Recycling and Reuse of Materials for Inert Filling" for Frei and Associates, LTD H <br />Property: 8400 Holly Street" dated June 02, 2008. The..report provides a plan to support beneficial use of <br />inert soils generated by the Denver Water Department and rock tailings from the crushing of granite to <br />increase the elevation and structural strength to complete the industrial development on property located <br />at 8400 Holly in Henderson, Colorado. The granite tailings are not considered to be disposed of as a <br />waste; rather it will be used as a recyclable material. The Plan proposes a mixture of 50% inert soil and <br />50% granite tailings to create a homogeneous product for use in back filling a former gravel pit. In the <br />Division's judgment this use of the mixture in manufacturing of a product meets the criteria of section <br />8.1 (a), (d) and (e) of the Solid Waste Regulations 6 CCR 1001-2. <br />Analytical data for the inert soils and granite tailings was provided i1a the document. The concentrations <br />reported in the materials fell below the TCLP and Colorado Soil Evaluation Values for unrestricted use- <br />Based on review of this document and discussions between us regarding this project, the Division <br />provides approval of the Fiore Fly Ash Project with the following conditions. <br />1. Frei and Associates must provide an annual recycling facility report that provides quantities <br />of materials accepted, used, generated onsite and sent ofisite.
