5. Drainage, Storm Water Management Plan (SWMP), and <br />SWMP Permit - Prior to mining opE'.rations being <br />commenced a Storm Water Management Plan (SWMP) with <br />relevant drainage information shall be submitted and <br />approved by the Department of Public Works and a <br />SWMP Permit from-CDPHE shall be obtained. <br />6. Conformance with Other County Regulations on Mining <br />- The County's other requirements on minimum 25' <br />setback from property lines, etc:. as outlined in <br />Section 11.340 will be followed and made a condition <br />of approval of the Conditional Use. <br />7. Inert Filling Allowed by DRMS Application - In <br />accordance with DRMS Regulations, the applicant was <br />required to certify that all inert material utilized <br />for backfilling would meet the below standard: <br />Rule 3.1.5 Reclamation Measures - Materials handling <br />The backfill material to be placed in the excavated area <br />will be "Inert Material" as defined in Rule 1.1 (20). <br />The material placed from 2 feet above the water line to <br />the bottom of the excavated area will be a mixture of <br />crusher fines, and dirt mixed with minor amounts of aged <br />concrete fragments. This material has no unique <br />characteristics that would cause it to have an impact on <br />groundwater. Crusher fines are fine materials left from <br />processing quarry rock we generate at another of our <br />mines. Above this the fill material will be aged <br />concrete, dirt, crusher fines, ma.5onry products and <br />asphalt. Any asphalt that is delivered will be reserved <br />and placed above the water line. <br />The Colorado Department of Public Health and Environment <br />(CDPHE)a received referral on the DRMS Application, had <br />no objection to the DRMS approval of this inert filling, <br />and didn't request any other approvals be obtained from <br />CDPHE. <br />8
