(Page 2) <br />MINE ID # OR PROSPECTING ID # M-1992-045 <br />INSPECTION DATE 7-17-2008 INSPECTOR'S INITIALS SSS, AJW <br />OBSERVATIONS <br />This monitoring inspection was conducted at the request of the landowners and previous permittees of this site, Deanna <br />and James Van Ella, who have indicated that the current permittee, Gold Mountain Metals, Inc., has defaulted on their <br />contract to purchase the property and consequently lost their right to enter and mine. Deanna and James Van Ella were <br />present for most of the inspection. <br />James and Deanna Van Ella have provided documentation that raises serious questions about the status of the operator's <br />right to enter and mine this site. By September 10, 2008, the operator will need to submit adequate proof that they <br />have legal right to enter and mine. If adequate proof is not submitted by that date, enforcement actions may be taken <br />that could result in revocation of this permit and forfeiture of the financial warranty. <br />The mine identification sign and affected area boundary markers are in place but a few more markers must be placed <br />ensure compliance with Rule 3.1.12. Affected area boundary markers still need to be installed to accurately delineate all <br />corners of the permit area including where the gaps are between the central parcel and the north and south parcels. <br />Based on the location of existing markers and paced distances from those markers and mine features, it was determined <br />that excavation and new road areas have been created outside the approved permit/affected area. An area of <br />approximately .07 acres has been excavated in the gap area between the central and north parcels. The excavation has <br />cut the toe out of the slope below the mine site and private property access road. This excavation area averages 50 feet <br />wide and extends south approximately 60 feet from the south boundary north parcel. A second off-site disturbance was <br />located extending up the gulch and out the south boundary of the south parcel. This disturbance consisted of a road and <br />some minor excavation. This area is estimated at .05 acres. This disturbance extended out from under a snow field <br />remaining in the bottom of the gulch. Some additional acreage may be disturbed under that snow field. This <br />disturbance beyond the permit boundary is very small. Therefore this off-site disturbance is noted as a problem. To <br />correct this problem the operator must backfill the off-site excavated highwalls to a stable 2:1 slope. Rough grade the <br />excavations and revegetate the disturbance per the requirements of the approved reclamation plan. If this corrective <br />action is not completed by October 20, 2008, this issue will be scheduled for hearing before the Mined Land <br />Reclamation Board as a possible violation. <br />It appears that the financial warranty for this site is currently inadequate to reclaim the site per the approved mining plan. This <br />is due to the additional acreage disturbance outside the permit area that will require backfill and stabilization not accounted for <br />in the permit. DRMS estimates that an additional $500 in reclamation liability exists for backfilling, grading and revegetation of <br />this .12 acre disturbance. This increase in financial warranty is due on October 20, 2008 unless adequate documentation has <br />been submitted to DRMS demonstrating that the above noted off-site disturbance has been adequately reclaimed per the <br />specifications of the approved reclamation plan. <br />A small off-site area on the hill above the east mine road, east of the old settling ponds has been disturbed. This <br />disturbance consists of disturbed soils where vegetation has been removed. The landowners indicate that this location <br />was used as a dump for the current operator. DBMS inspectors were unable to verify this information and, because the <br />site consists of private operations such as the shop/residence that are not part of the permit, could not determine if this <br />location had been affected by mining related operations or for domestic reasons. The operator is cautioned that any <br />such disturbances that are mining related will be viewed as off-site damage for which the operator will be held <br />accountable. For domestic disturbance to be conducted in the vicinity of the mine permit area, the operator is strongly <br />encouraged to notify DBMS prior to initiation so a note can be placed in the file. <br />No significant infestations of noxious or other problematic weeds were noted on site during this inspection. <br />No significant erosional features were noted on the affected areas of the site.
