Notice of Proposed Decision
The Colorado Division of Reclamation, Mining and Safety has issued a proposed decision to approve
Bond Release Application No. 6 (SL-6) for the Golden Eagle Mine, Permit No. C-1981-013. The mine
is operated by New Elk Coal Company, LLC under the provisions of the Colorado Surface Coal Mining
Reclamation Act of 1979. The bond release application was submitted by New Elk Coal Company, LLC
on September 20, 2006. The application is requesting a Phase III bond release for 51.5 acres of
reclaimed land previously Phase II released and a Phase I, II, and III bond release for 5.6 acres of
former ponds 3 and 4. The applicant is also requesting a liability release of all affected areas overlying
underground workings north of Colorado Highway 12. Excluded entirely from this request are 1.2
acres known as the NW-1 airshaft. The dollar amount of reclamation liability proposed for release is
$69,793.49 which will leave a remaining required bond amount of $72,099.00.
The affected area is located in Las Animas County, approximately 20 miles West of Trinidad, Colorado.
Copies of the proposed decision are available for review at the Colorado Division of Reclamation, Mining
and Safety office, 1313 Sherman Street, Room 215, Denver, Colorado 80203, and at the office of the Las
Animas County Clerk and Recorder.
Any person who has an interest which is or may be adversely affected may request an adjudicatory
hearing regarding this proposed decision. Requests for a hearing must be made in writing within thirty
(30) days of the first publication of this notice, and shall state with reasonable specificity the reasons for
the request and objections to the proposed decision.
