Notice of Proposed Decision <br />The Colorado Division of Reclamation, Mining and Safety has issued a proposed decision to approve <br />Bond Release Application No. 6 (SL-6) for the Golden Eagle Mine, Permit No. C-1981-013. The mine <br />is operated by New Elk Coal Company, LLC under the provisions of the Colorado Surface Coal Mining <br />Reclamation Act of 1979. The bond release application was submitted by New Elk Coal Company, LLC <br />on September 20, 2006. The application is requesting a Phase III bond release for 51.5 acres of <br />reclaimed land previously Phase II released and a Phase I, II, and III bond release for 5.6 acres of <br />former ponds 3 and 4. The applicant is also requesting a liability release of all affected areas overlying <br />underground workings north of Colorado Highway 12. Excluded entirely from this request are 1.2 <br />acres known as the NW-1 airshaft. The dollar amount of reclamation liability proposed for release is <br />$69,793.49 which will leave a remaining required bond amount of $72,099.00. <br />The affected area is located in Las Animas County, approximately 20 miles West of Trinidad, Colorado. <br />Copies of the proposed decision are available for review at the Colorado Division of Reclamation, Mining <br />and Safety office, 1313 Sherman Street, Room 215, Denver, Colorado 80203, and at the office of the Las <br />Animas County Clerk and Recorder. <br />Any person who has an interest which is or may be adversely affected may request an adjudicatory <br />hearing regarding this proposed decision. Requests for a hearing must be made in writing within thirty <br />(30) days of the first publication of this notice, and shall state with reasonable specificity the reasons for <br />the request and objections to the proposed decision.
