• a Phase I, ll, and I I I bond release for .1 acre reclaimed adjacent to the former <br />railroad track; and <br />• release of liability for approximately 633 acres of land overlying underground <br />workings not previously released but excluding any areas of workings below the <br />1.2 acres at the NW-1 ventilation shaft <br />The total disturbed area that is Phase III released is 57.1 acres and total affected area <br />released over underground workings is approximately 633 acres. The Division <br />terminates jurisdiction over 57.1 disturbed acres and 633 affected acres as a result of <br />this proposed decision. The remaining disturbed and affected acres are 1.2 acres <br />associated with the reclaimed NW-1 ventilation shaft. Ground water wells that remain <br />include SF-1 and a short section of access road, NM-20, NM-21, NM-22, NM-23, SF-2, <br />and LA-218. All of these wells will require abandonment and reclamation in the future <br />and none are approved to remain as permanent at this time. <br />Ownership of the 1.2 acres remaining under bond is private for both the surface and the <br />minerals. No Federal ownership exists within the 1.2 acre permit area after approval of <br />this bond release. <br />The reclamation liability will be reduced by $69,793.49, which when subtracted from the <br />current reclamation liability amount of $141,992.49, leaves $72,099.00 as the required <br />amount of performance bond to be held by the Division and the State of Colorado. <br />Public notice of this proposed decision will be published once a week for two weeks in <br />the Chronicle-News as soon as possible. Any person with a valid legal interest, which <br />might be adversely affected by this proposed decision, may request a formal public <br />hearing before the Mined Land Reclamation Board in accordance with Rule 3.03.2(6). <br />Requests for public hearing must be submitted to the Division in writing within thirty <br />days of the first publication of the public notice. If no hearing is requested, the <br />Division's decision will become final.
