III. COMMENTS— COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> The SLA Phase 1 bond release inspection report was issued 8/24/06, based on inspection conducted 8/7/06 <br /> through 8/11/06. Maintenance problems noted in the SLA inspection, potentially relevant to the SL-3 inspection, <br /> included the following: <br /> (a) Road ditch erosion along a segment of the South Light Use Road; <br /> (b) Ruts along northern section of Road El; <br /> (c)Old drill hole not properly backfilled along fence line due south of PM-613; <br /> (d)Slide associated with seep from reclaimed highwall south of Pecoco Pond; <br /> (e) Minor erosion in PM-6 channel above Stock Pond T-32; <br /> (f) Minor rilling on east side of PM-6 below Road F; <br /> (g) Rills in PM-4 watershed above beginning of the PM-4 channel; <br /> (h) Erosion along PM-23 channel; <br /> (i) Minor erosion along PM-2 channel; <br /> 0) Substantial gully on south side of Channel PM-22; <br /> (k)Gully in Channel PM-10 just below the Solid Waste Disposal Area; <br /> (1) Gullied tributary drainage that enters PM-10 from the west, north of Stock Pond T-4; <br /> (m)Small hole in area of reclaimed highwall south of the gullied tributary. <br /> Additional maintenance problems (not related to"Pre-law" areas) noted in inspections subsequent to the SLA <br /> inspection, include the following: <br /> (n)"Problem"weeds were noted in several reports, notably in the vicinity of stock ponds and sediment ponds; <br /> (o) Rill erosion on South Road B; 10/11/07 inspection; <br /> (p)Slump in East Wadge Area, north of Pond 8; 5/29/08 aerial inspection. <br /> Status of these previously identified problems, based on observations made during the SL-3 inspection, is as <br /> follows: <br /> (a) Ditch erosion along the South Road noted in original inspection was apparently repaired, based on <br /> subsequent inspection report comments. However, based on SL-3 inspection, a steep segment of ditch along <br /> the road between Pond 004 and Pond 008 has eroded, and repair is warranted. See Photo 3975, and GPS <br /> Feature#39, in the attachments to this report. This eroded ditch segment was not identified on the 2008 Rill and <br /> Gully Survey Map. <br /> (b)The specific location of the ruts noted along the northern section of Road E1 is not clear. During the SL-3 <br /> inspection, minor rilling was noted along and adjacent to the Road E1 travel surface in the vicinity of Channel <br /> PM-22, which may have contributed to a hillslope gully that runs north into the upper reach of PM-22. Photo <br /> 3958 shows minor rilling adjacent to road travel surface in this general vicinity. Installation of water bars is <br /> warranted along this section of road,to minimize concentrated runoff. Seeding will be warranted in <br /> association with rill repair/water bar construction along the disturbed area adjacent to the travel surface. <br /> (c)The open drill hole noted in the original report was noted subsequently on an inspection of 4/26/07. Status <br /> was not checked during the SL-3 inspection. It will be checked on follow-up inspection, prior to issuance of a <br /> proposed decision on SL-3. If the hole has not yet been properly reclaimed, it will need to be reclaimed <br /> prior to issuance of the SL-3 proposed decision. <br /> d), (h), and (i) pertain to erosion and slide features immediately south of the Pecoco Pond. Repairs to these <br /> features were undertaken in 2007, and they appear to be stabilizing. An old slide feature on the upper portion of <br /> the reclaimed highwall is well vegetated. An adjacent slide area slightly higher on the slope was repaired last <br /> year, as was a small slide lower on the slope and further to the south, associated with a saline seep. These <br /> features are shown on Photos 3951 (reclaimed section of highwall slope with the three slide areas), 3955(older <br /> vegetated slide feature high on slope)and 3956(slide repair/seep area at toe of slope). The upper slope slide <br /> area is GPS Feature 2. There does not appear to have been further movement this spring on the slope, and <br /> 5 <br />
