III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a partial coal inspection conducted by Jason Musick of the Colorado Division of <br /> Reclamation, Mining, and Safety (Division) on 04 August 2008. The weather was clear and the <br /> ground was dry during the on-the-ground inspection of the site. <br /> Roads <br /> The Old Tipple Road, North Road, Lower Moffat Road, Center Ridge Pond Road, West Ridge Pond <br /> Road, and West Ridge Road were dry. All roads appeared to be stable and in compliance with no <br /> problems noted at the time of the inspection. <br /> Hvdroloaic Balance <br /> The Moffat Pond contained a small amount of clear water at the time of the inspection. The Moffat <br /> Pond utilizes a 12" corrugated steel pipe primary spillway and a rock lined emergency spillway. The <br /> primary spillway had a trickle of water discharging at the time of the inspection and the spillway <br /> appeared to be functioning as permitted. The emergency spillway appeared to be stable with no <br /> problems noted at the time of the inspection. Moffat down drains 1 through 4 and the Moffat Final Pit <br /> down drain appeared to be dry and stable at the time of the inspection. Water draining from the seeps <br /> and springs at the southern end of the pond was entering the pond at the southern inlet. The pond <br /> embankments appeared to be well vegetated and stable with no signs of erosion or damage at the <br /> time of the inspection. <br /> The Center Ridge Pond contained water at the time of the inspection. The Center Ridge Pond utilizes <br /> a corrugated steel pipe primary spillway and a rock lined emergency spillway. The discharge at the <br /> time of the inspection was approximately %full through the 36" primary spillway. The emergency <br /> spillway appeared stable with no sighs of water flow. The pond embankments appeared stable and <br /> well vegetated at the time of the inspection. <br /> The West Ridge Pond contained water at the time of the inspection. The West Ridge Pond utilizes a <br /> corrugated steel pipe primary spillway and a rock lined emergency spillway. There was a trickle of <br /> water discharging at the time of the inspection. The emergency spillway appeared to be stable with no <br /> signs of damage at the time of the inspection. The pond embankments appeared stable with good <br /> vegetation and no signs of damage or erosion at the time of the inspection. The lower cell of the <br /> West Ridge Pond contained water and appeared to be stable and well vegetated at the time of the <br /> inspection. The "String-of-Pearl' check dams were dry at the outlet, with some ponding at the check <br /> dams toward the middle and top of the drainage. <br /> All permanent impoundments at the Edna Mine appeared to be in compliance with Rule 4.05.9 at the <br /> time of the inspection. The Impoundments appeared to have functioned as designed through the <br /> recent spring run-off. No sign of erosion or damage was noted at the time of the inspection. <br />
