III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a partial inspection of the Elk Creek Mine and Sanborn Creek Mine (Permit No. C-1981- <br /> 022) conducted by Marcia Talvitie of the Colorado Division of Reclamation, Mining and Safety <br /> on 29-Jul-2008. Jim Kiger, Environmental Manager for Oxbow Mining, LLC (OMLLC) was present <br /> throughout inspection. <br /> _Hydrologic Balance <br /> • Pond B had been mucked out since the previous month's inspection (Figure 1). <br /> • Pond D was not full, and was not discharging at the time of the inspection. <br /> • Pond E, below the II West Coal Refuse Facility,was dry (Figure 2). <br /> • Pond F contained no visible water, but cattails continued to thrive in the bottom of the <br /> pond. <br /> • East Yard Pond - wet material mucked from Pond B had been hauled to this pond to be <br /> dewatered sufficiently to allow transport and placement in the coal refuse facilities. The <br /> material will be hauled to the fills as soon as feasible, so as not to diminish the available <br /> capacity of the East Yard Pond. <br /> • Substation 3 Pond was dry. <br /> General Mine Plan Compliance <br /> There had been recent activity at the Substation 3 site by Vessels, as they continue to evaluate <br /> the potential of collecting methane. (The fan shaft has been previously blocked and filled.) <br /> Reveaetation <br /> Vegetative cover at the Pond D impoundment and the Somerset Mine Portal area and appears <br /> to be healthy. Weed control efforts are on-going at numerous locations within the permit area. <br /> Knapweed spotted at the Hubbard Creek Fansite in June had been recently sprayed and was <br /> beginning to wither (Figure 3). Canada thistle will be sprayed, as well. <br /> Excess Spoil & Development Waste <br /> Development of the II West Coal Refuse Facility continues.
