NOTICE OF PROPOSED DECISION <br />The Colorado Division of Reclamation, Mining and Safety proposes to Approve Technical Revision <br />Application No. 71 (TR-71) for the Colowyo Coal Mine (Permit No. C-1981-019), submitted by <br />Colowyo Coal Company L.P. The Colowyo Coal Company has submitted a Technical Revision for the <br />Colowyo Mine to extend the currently permitted Section 16 Pond ditch approximately 750 feet. The ditch <br />extension will direct some of the South Taylor disturbed area runoff to the Section 16 Pond until the <br />construction of the Section 21 Pond is completed. This revision includes a new hydrology map and <br />changes to the hydrologic modeling for the Section 16 Pond. All of the lands for the proposed extension <br />are within both the mine's disturbance boundary and permit boundary. Since all of the lands for this <br />revision are contained within the South Taylor Pit shell, it is not anticipated that there will be any increase <br />in the mine's reclamation liability as a result of this revision. <br />The Colowyo Coal Mine is a surface coal mine located in Moffat County, approximately 28 miles south <br />of Craig, Colorado. Coal interest is Federal, and the surface affected is Federal, state and private land. <br />The permit area encompasses approximately 12,250.95 acres. <br />This proposed decision is based on a finding that the proposed operation will comply with all <br />requirements of the Colorado Surface Coal Mining Reclamation Act, Section 34-33-101, et seq., C.R.S., <br />and the regulations promulgated thereunder. <br />Copies of the proposed decision, including stipulations, are on file for public inspection at the Colorado <br />Division of Reclamation, Mining and Safety, Room 215, Centennial Building, 1313 Sherman Street, <br />Denver, Colorado 80203. Persons with an interest that may be adversely affected by the proposed <br />decision may request a formal hearing before the Mined Land Reclamation Board on the proposed <br />decision. Such request must be made within ten (10) days of the initial publication of this notice, must be <br />in writing, and must state with reasonable specificity the reasons for the request and the objections to the <br />proposed decision.
