implementation of any of the above measures would have reduced inflow to the Prospect <br />pond. <br />The Prospect Pond situation is a violation of a number of Rules. <br />4.01.1(7) <br />4.05.3(1)(d) and (e) <br />4.05.3(3) and (4) and (7)(a) <br />4.05.6(3)(a) and (c) <br />4.05.9(b) and (c)(ii) <br />4.05.9(10) <br />This is the second or third time that this pond has not only exceeded water quality limitations <br />but been overwhelmed by storm runoff. Water quality issues are secondary at this point. <br />Public safety is of paramount importance regarding this pond and its disturbed watershed. <br />Encountering a paved surface covered with mud, water, and debris at even moderate <br />highway speeds could most certainly result in loss of vehicle control at best. I believe the <br />Division needs to aggressively pursue this issue to prevent accident, injury, or death on <br />Colorado Highway 13 immediately downslope of the Prospect watershed. My <br />recommendation is that what were previously Division requests and suggestions should be <br />elevated now to demands and requirements to ensure that the situation is addressed in the <br />best interests of the public at large.
