Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division received the Oxbow Mining, LLC (OMLLC) application for Technical <br />Revision 59 (TR-59) on 28-Apr-2008, and determined the application to be Complete on <br />08-May-2008. <br />Rule No. 2.08.4(6)(b)(iii) states that the Division shall issue a proposed decision within <br />60 days after the application is determined to be complete. In the case of TR-59, the <br />decision due date was 07-Jul-2008. OMLLC has not yet provided the Division with the <br />Tract #4 Federal Coal Lease Modification from the U.S. Forest Service. Thus, the <br />Division is not yet able to proceed with the Decision process. <br />Please submit a request to the Division that the Decision Date for TR-59 be extended. <br />Best regards, <br />Marcia L.
