• asserting that it fails to: analyze properly the project's cumulative effects on global <br />warming; analyze reasonable alternatives to reduce the potential greenhouse gas <br />emissions of the mine expansion, including the alternatives of flaring of vented methane <br />or capture of methane; include a reasonably complete discussion of measures to mitigate <br />impacts of releasing methane into the atmosphere; and ensure compliance with the Clean <br />Air Act. OSM, as a cooperator, independently reviewed the EIS and concluded that it <br />adequately analyzed and describe alternatives, impacts, including cumulative impacts, <br />and mitigation measures of the proposed mining operation. The Summary of the Final <br />EIS is included in this decision document. The full EIS is available from Charles <br />Richmond, Forest Supervisor, Grand Mesa, Uncompahgre, Gunnison National Forests, <br />2250 Highway 50, Delta, Colorado, 81416. <br />OSM's review of the proposed action did not identify any issues that required resolution <br />via the addition of special conditions to the mining plan modification approval. <br />On November 14, 2007, Mountain Coal Company, L.L.C. published in the Delta <br />County Independent the fourth consecutive weekly notice of the availability of an <br />administratively complete permit application package. During the review period no <br />public comments were received. <br />. The CO-DRMS determined that $13,905,979.00 is adequate for the total reclamation of <br />Colorado Permit C-1980-007 associated with this mining plan. CO-DRMS currently <br />holds a bond for $14,500,000.00. The bond is payable to the State and the United States <br />of America. <br />A chronology of events related to the processing of the PAP and this mining plan decision <br />is included with the decision document. The information in the PAP, and other <br />information identified in the decision document, has been reviewed by CO-DRMS staff <br />in coordination with the OSM Federal Lands State Coordinator. <br />OSM's administrative record of this mining plan modification consists of the following: <br />- the PAP submitted by Mountain Coal Company L.L.C., and updated through <br />March 24, 2008, <br />- the Colorado Division of Reclamation, Mining and Safety's (CO-DRMS) <br />West Elk Mine (Permit No. C-1980-007) Proposed Decision - Technical Revision <br />No. 111 (TR-111) E Seam Methane Drainage Wells for Longwall Panel El <br />(Conceptual Plan), <br />- the Final Environmental Impact Statement entitled, Deer Creek Shaft and E <br />• Seam Methane Drainage Wells Project EIS, prepared by the U.S. Forest Service <br />with OSM as a cooperating agency, and
