• <br />1. On May 23, 2007, Mountain Coal Company, L.L.C. submitted Technical Revision <br />109 to the CO-DRMS proposing to construct the Deer Creek Shaft (and <br />Escapeway). This Technical Revision was approved by CO-DRMS on July 24, <br />2007, and the mining plan modification was approved by the ASLM on <br />October 31, 2007. <br />2. On October 15, 2007, Mountain Coal Company, L.L.C. submitted Technical <br />Revision TR-111 to CO-DRMS. TR-111 proposes to install sixteen <br />(16) methane drainage wells on fourteen (14) well pads and to construct 1.52 <br />miles of access roads disturbing a total of ten (10.0) surface acres of Federal <br />leases C-1362 and COC-56447, and is the subject of this mining plan <br />modification. <br />3. On October 15, 2007, Mountain Coal Company, L.L.C. submitted Technical <br />Revision TR-112 to CO-DRMS. TR-112 proposes to install up to152 methane <br />drainage wells on 131 well pads and to construct 10.02 miles of access <br />roads disturbing 80.02 surface acres of Federal leases C-1362 and COC-067232 <br />over the next twelve (12) years. This Technical Revision is currently under <br />review by CO-DRMS and a decision is expected within the next few months. <br />• One additional mining plan modification will need to be prepared for ASLM approval for <br />item 3 above. <br />M. The Proposed Action <br />This mining plan action consists of a mining plan modification for Federal leases C-1362 <br />and COC-57447. Specifically, the mining plan action proposed by Mountain Coal <br />Company, L.L.C. consists of the installation of sixteen (16) methane drainage wells on <br />fourteen (14) well pads and the construction of 1.52 miles of access roads disturbing a <br />total of ten (10.0) surface acres of Federal leases C-1362 and COC-56447 within the area <br />covered by Colorado State permit C-1980-007, in portions of: <br />Township 13 South, Range 90 West 6"' P.M. <br />Sections 26, 27, 28, 34 and 35portions thereof. <br />The projected life of the mining operations is not expected to change under Colorado <br />Permit C-1980-007 and this proposed mining plan modification. However without the <br />approval of this mining plan modification the build up of methane in the mine's <br />atmosphere would result in immediate closure of the mine by the Mine Safety and Health <br />Administration for health and safety reasons. <br />• The average annual production rate and the maximum production rate would not change.
